I have a solo proprietorship company and I made agreement to the insurance company that in the event of anything should happen to the premises and to the business, the insurance will cover it up. But then, later on when I made the business into a limited company fired caught up the premises and my business, therefore I make a claim to the insurance company. But, the insurance company refused to pay because there was no assignment of the benefit of the insurance policy to the company, nor did the company effect its own insurance against such risks. so what Im asking is, did the insurance company trying to make a fraud out of my company because it is in fact, the company is my company even though I changed the type of the company into a limited company and I appointed myself as a sole director.
Thank you soo much for answering, it will help me a lot since the case I pressed charge is on the hearing next week, on monday |

You may want to have insurance counsel carefully review the agreement you signed. Technically they are correct but you may have a number of equitable and fairness arguments you can make that may still allow you to collect.
