American women married to Egyptian man in Egypt. Is the marriage legal in USA NJ?
Hello I was married three years ago in Egypt. We never brought the final marriage certificate to the us embassy to make it legal in america. I would like to divorce my husband. For a little over a year I have been back in america he has never been here and I don't plan to go back am I free to remarry here in America without receiving a divorce from him would it be legal? Or if not legal how would I go about getting one from there when I am here in America. Please help

I wish to inform you that your marriage in Egypt will be a valid marriage in USA. Recognition of foreign marriage will be under New Jersey law but generally if a valid marriage is performed abroad then it will be recognized in New Jersey. You may obtain divorce in USA in New Jersey as you reside in New Jersey. The requirement for divorce is that either of the parties to divorce must reside in USA. Thus you may have divorce in USA. Law confer jurisdiction to a court in New Jersey if at least one spouse is residing there and at present you are living in New Jersey.

If your marriage in Egypt is valid it is recognized by U.S. So you are required to obtain a divorce from that marriage. As you were residing in New Jersey, you can file a petition for divorce in New Jersey. Either of the spouses country has jurisdiction over divorce petition.

Legally, here in the USA I would imagine that you could get married again without any problems with paper work
