Default USA company Sueing Canadian Company

Can a US company sue a Canadian Company?? One of my US suppliers had a spat with one of my US customers and my customer is suing my supplier. Now, my supplier wants to sue us for the legal costs. From my understanding it is quite costly for him to do so??

He can do so if he can argue the cause of action arose in the USA and that you are doing business there. But it will cost him yes. It is not cheap to file and litigate.

What was the dispute about, if you care to mention it?

We are Incorporated and based in Canada. We sell over the internet. We have US customers and Suppliers. My supplier dropshipped a product (ie. $1800 motorcycle) to my customer. The bike arrived scratched up and was damaged in shipping I told my supplier and he filed a claim with the courier company. The courier company sent my supplier $450 check for the parts... the supplier sent out parts to replace what was damaged. The customer is now saying that he needs the frame replaced because it was scratched but the supplier can't reopen the claim because the check was cashed from the courier company to settle the claim. Now the customer is trying to sue the supplier for $1800. The supplier is POD and want to counter sue the customer and then sue us for the legal fees.

*** "Pound sand" is the first thing that come to my mind but I want to see what course he could take first.

If he settled with the courier company it normally would mean he cannot then come back at you. He could have waited and reached a more appropriate settlement. It will be hard to sue you at this point unless you guaranteed the arrival condition. Even then it may be hard for him given his actions.

Out of curiosity, how easy is it for a US based person/company to sue a Canadian based company? I heard it is very costly.
