Default Polanski sex case appeal set for December 10 (AFP)

AFP - Lawyers for Roman Polanski will argue for the director's 1970s child sex conviction to be dismissed for judicial misconduct at a hearing in Los Angeles next month, legal sources said.

A three-judge panel from California's 2nd District Court of Appeal will hear Polanski's lawyers attempt to overturn a lower court ruling in May, where a judge dismissed the case on the grounds of Polanski's absence.

Polanski's lawyers have argued for the conviction to be set aside on the grounds that the judge and prosecutors in the 1978 case colluded improperly.

Sure Roman Polanski, who pleaded guilty three decades ago to having sex with a 13-year-old girl, claims is was statuary rape. For this to be STATITORY RAPE the girl HAS TO BE ABLE TO VOLUNTARILY COSENT to the sexual act!!
If you READ the partial Grand Jurry transcript (posted on thw www) you will her say that he gave her booze, 'ludes and was afraid of him. Each of these 3 items remove the "VOLINTARY CONSENT" from this act which means that this 13 year old WAS RAPED!!!
It is it NOT SRTANGE that 5 years later, whwn she was 18 ald OLD ENOUGH TO CONSENT TO A CIVIL SETTLEMENT, that she was paid a settlement 'BRIDE TO DROP THE RAPE COMPLAINT' that a payment of $ 500,000 was made????
