I would like to start out by saying that this is my first time in this forum. I am an international studies major and currently abroad carrying a course in environmental law which is a bit of a struggle for me because of the language, technical jargon, being my first law class, different teaching styles, different environment, etc.
I am not looking for a handout but rather a better explanation of exactly what is a jurisprudence and a doctrine in simple terms for a beginning student of law or better, for a person who doesn´t know law. I would like recommendations on how to research and find doctrines and jurisprudence for international environmental law, related to the ozone cap, the Viena Agreement for the Protection of the Ozone, and the Montreal Protocol on Substances That Deplete the Ozone Layer. My professor explained to me that a jurisprudence is simply the sentence of the court. So please correct me if I am wrong, but shouldn´t I be looking for a sentence from a case that went through the International Court of Justice, the Law of the Sea Court, the European Court of Justice, or reional treaty tribunals that is about the ozone cap? What would the sentence be like? Would it state what not to do inorder to preserve and protect the ozone cap? Now doctrines, is a doctrine used like a principle to help in the process of judging a case or in the creation of declarations or agreements? I am just a bit confused in the definitions that I have. Please help me understand what I have to do in order to find doctrines in international environmental law. Thank you in advance |

but could you not give me any direction into what I am looking for? I have found cases and sentences about Spain and the ozone cap, which I believe are also considered to be jurisprudence on a web site for the European Court of Justice, but as a study abroad University student and non law major, I am a bit confused and overwhelmed. I can not simply "google" jurisprudence international environmental law nor jurisprudence or sentence about the proteccion of the ozone cap. I would like someone to give me the name of a website no more to help me in this difficult situation. thank you |
