My wifes ex-husband returned to Israel two months ago and has since has stopped making child support payments (he hold an American & an Israeli citizenship). He should be paying for the next eight years.
Under international law or extradition agreement between the US and Israel, can we apply for a petition/motion to request that Israel will extradite him back to the US? And will they? Can we claim its a felony? We assume it will be a lengthy process and we are not wealthy. Should we even spend the time and money on this endeavor? Thanks |

If the amount is over 5000 or 10,000 dollars due you can get his passport blocked and can seek a felony warrant for his arrest. They likely will not extradite but he will have a warrant for his arrest and at some point they may snag him.

If I were you, i would hire an israeli attorney that resides in israel for your question. i got burned by ca lawyers who thought they knew international law. yes, all below is true but in israel they don't won't chase him, so, you hire a lawyer and a detective in israel to know where his work of place is, ;you then, have the israeli lawyer submit a garnishment at his place of work

As a former assistant prosecutor, I initiated the first international extradition for failure to pay child support in the United States with Israel. Israel and the US have an extradition treaty that lists "willful non support" of a child as an extradictable offense. You need to get your state to issue a felony warrant and then contact the Department of Justice - Israel Interpol liasion - and that person can start the voluminous amount of paperwork required to extradite from Israel. If you find a prosecutor with the desire to go this far, be thankful. It took me months of work and phone calls at 3am to get this to happen for my victims.
Also, Israel has the doctrine of aliyah which can mean if he becomes an Israeli citizen part of the charge period is exempt under the Law of Return. If he is not an Orthodox Jew, then he is not protected under the Law of Return. |
