In April of 2005, my neighbor backed her SUV over my 2 year old daughter while pulling out of her driveway. I was also hit trying to pull my daughter out of the way.
Thank goodness, my daughter only suffered scrapes, bruises and a bloody nose, but she was examined in the ER due to her being under the vehicle and right next to the wheel. I suffered a scraped knee and bruised jaw from hitting the pavement but I was not examined by a doctor. My health insurance paid the hospital bills and the neighbors insurance company did cover the deductible payment that I was responsible for. My insurance needs to be reimbursed from my neighbors insurance so we are in negotiations for settlement. I am finding that her insurance company is not willing to pay out very much more than the bills itself. Their last offer was about $1000 more than the bills. I also know that they dropped my neighbor's coverage after the accident, telling her that she is lucky I don't sue them for her Homeowners policy and Auto policy (since it happened on her property). I just feel that they are coming in very low for a settlement. I know her injuries were minor, but emotionally this was quite traumatic for both her and me. Does anyone have any opinions on this? |

It is certainly possible you have a case based on what you say here; you should take a brief description of these events as well as your medical records to an injury attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you...
