Confused Insurance Issue

To whom this may concern:

My girlfriend gave birth to my son on 4/13/07. Her last day of work before going on maternity leave was 3/30/07. When she left she was entered in the system as under maternity leave. So should have still be covered under their health insurance. When she left she also picked up Medicare. The claim was paid by the insurance company on 4/24/07 with no problems. But recently the hospital called and said the insurance company pulled their payment of $2600 on 10/17/07 (6 mths later) because she was not covered. Her HR dept. at her job said she was put in as terminated on 4/05/07 and that was the last day of coverage. Also, that she should have contacted Cobra. We contacted Cobra and they said claims need to be filled within 60 days. But the problem is that the claim was paid so there was no need to contact them until now and now we have a $2600 bill that the insurance co. and Cobra refuse to pay. Any information you can provide will be helpful.

You do have to apply for Cobra...call HR and get a full record of what happened. Then you can decide what to do.

In Florida, state law says you are covered for the first 30days, even after dismissal...Cobra has to be applied for if you want it within a specific amount of time, and the amount of time can vary by state. But if your dates are correct, you are automatically covered for the first 30 days after leaving employment. If maternity was part of the coverage it should be paid by the company..its the law...I have never heard of a claim being "pulled" 6 months after the fact....I have been involved with hundreds of health claims, I am a licensed health insurance agent.
