in 2005 my husband settled with an insurance company and the amount he settled for was put into 2 annuities. At the same time, my husband designated myself (his wife) and his adult daughter as his beneficiaries. My husband has now passed away and I submitted his death certificate and required documentation to the insurance company. Several weeks passed and I called to see when I could expect to recieve my benefit. I was told that due to the fact that his daughter had also submitted for benefits--that this matter would have to be reviewed by their legal department. I assumed since benficiary does not go through an estate but directly to the named person or people that this matter would be resolved relatively quick. What is the legal problem that needs addressed? The beneficiary documentation reads very clearly.

You are correct. Ask for the delay to be explained in writing. That should be done asap. Tell them you will file a complaint with the insurance commission and attorney general if this is not resolved.

If your husband has an estate, the value of the annuities may be added to the estate for tax purposes....it depends on how its set up. Beneficiaries do get money, but...how large the estate is and what type of annuity makes a big difference on taxable inheritance. Find a good local insurance agent that is familiar with the companies the annuities were created with. You have lots of options here. Most companies that carry annuities pay within 90 days.
