Medical History Information

As part of the process for applying for benefits, my employer has asked me to fill out an "Evidence of Insurability" form, which includes a medical history.

In that medical history, it asks if I have ever used controlled substances. It also asks for the name and phone number of my current physician.

The facts: I actually did have an addiction over three years ago, but I was able to quit completely with no relapses without seeking counseling or rehab. Although I sought no treatment for the addiction, I *did* tell my current primary physician about that part of my past, simply in the interest of full knowledge and disclosure.

1. Am I legally obligated to mark "yes" on the form, even though I was able to overcome the problem on my own without seeking treatment?

2. If my physician is asked to confirm the history, is he legally obligated to notify them about the previous addiction, even though he only knows about it because I chose to reveal it (i.e. it was prior to me seeing him, and I have no medical record of rehab or counseling)?

Can you truthfully say yes but according to a prescription and leave it at that?
