Yes, you can file a small claims suit against your insurance company. I had to file a small claims case again my car insurance company one time. You will need proof that you tried to recover your damages from the insurer or whomever you are suing for the money.

Q: Auto Insurance Claims - Do I sue the driver, or his insurance company?

A: You would file suit against the driver in the caounty where he lives. If you win your case you will presend the judgement to the insurance company for payment. Your case will have two aspects. First you will have to prove liability (that the other driver is at fault) and then you will have to prove damages. So you willneed to bring repair estimates, rental car estimates, etc.

I want to say you can contact the county courthouse and ask them what forms, cost, etc.
