Default Rental Car Insurance Problem

I rented a car in Hawaii. The agent tried to sell me differing packages of 20 to 40 dollars a day. I asked the rental agent about my gold visa card coverage and he told me that he would only trust American Express Gold and recommended I take their insurance. I accepted the LDW for (loss damage waiver) $11/day which covered only up to $3000 of damage. I thought this could augment my credit card insurance and accepted it.

A accident occured and the rental car may be a write-off. When contacting Visa they informed me they could not cover the car because by accepting the LDW with the rental company, that has voided the coverage given by the credit card (which would have covered all damages to the car, including loss of use, plates, etc.).

I know I should have read the small print of my Visa coverage, but I feel that there is something wrong with selling and making a client pay for inferior insurance, and for insurance that voids their pre-existing coverage.

My question is that I am a Canadian citizen residing in Canada and what consequences would there be for me if I refused to pay? Could a civil suit for monetary damages be enforced here in Canada? If a collection agency pursued this what could they do to me in Canada, and could that affect my credit rating? Thanks for any help or advice...

They could sue you in the US and eventually try to enforce it in Canada--it takes time and is not so easy to do. They could file suit where you reside as well.

I think you may be able to push the issue a bit with the card company. You could argue that that really was not made clear and you should have had full coverage from them--they got paid for it all...they may compromise with you.

Most major rental car companies that offer the LDW will cover the entire cars worth. Only 3,000 does not sound right. I would contact the rental cars loss control office and demand they cover it. Good luck!

40$ a day is way too much for rental car insurance.. i was able to get it down to about $10 / day

Rental car insurance can be confusing. You need to make sure you have enough insurance to cover you in case you have an accident, but you don´t want to pay for coverage you already have.
