A building (newly constructed, pre-engineered steel building) collapsed under the weight of snow (13"). My insurance company seems to be playing games instead of paying for the loss. Would I be better off going after the company that sold me the building, or should I depend on my insurance company to do the right thing? My insurance company brought in a forensic engineer to try and determine why the building collapsed. The engineer said, "The building was constructed properly." And now they are trying to determine wheather the company sold me the proper building, for this area. Since it collapsed under 13" of snow, I believe they sold me an improper building and I want them to send me the proper building and pay for the demolition of the collapsed building. This only seems right, to me.
Thank you for your help. |

Based on what you say here, you could file suit against both of them (or at least threaten to do so) in small claims court or in regular court, and let them fight it out as to which is responsible.
