Confused Requesting cancellation of current health care

My husband's guard unit was activated in October 2007 for eight months. While away, his employer placed him on a leave of absence so there would be no health insurance premiums collected while he was on active duty. Now that Tricare has a guard and reserve program, which is MUCH better coverage and more affordable, we are trying to go with that coverage. His employer said that he is locked in his policy for 2 more years. Tricare guard and reserve has been made available for the family recently, and since we are currently in our 180-day period of military benefits after coming off of orders, we would like to opt out of the employer offered insurance and go with the military insurance. Is there some way to get out of it? Should he not be able to choose from where his coverage is supplied? Is there any state laws (SC) that can help?

I would have him question more of the "locked in for two years" thing- did he sign a contract agreeing to that? If he signed a contract, then it may be harder for him to opt out. His employer/insurance agent just might be telling him that he's locked in for their own personal gain. You could also call a military Tricare Liason at your closest military base, and they can help you. The Tricare Liason's can do amazing things to help out soldiers and their families!
