Default Reimbursing medical insurance after an auto accident.

On February 4, 2008, my wife and I were in a severe auto accident. As the day was extremely foggy and rife with other accidents, the Illinois State Police issued no tickets to us or the truck driver whose trailer we drove underneath of. We had only liablity with State Farm Insurance and they have already paid their 5000 per person in medical as is standard with liability. In addition to that claim, we are also pursing an underinsured driver claim for myself as the passenger in the vechicle. My question is what money, if any can my medical insurance claim for reimbursement if I do get the underinsured driver claim. (max benefit is 100,000 and my medical bills have far exceed that.) I just don't see the point in pursuing a claim that might very well increase my premium if I don't get any money for pain, suffering and the cost of a new vechile???? Please help with my confusing and frustrating query.

Your SF underinsured coverage won't pay anything for your car. It covers bodily injury only. In addition, SF does not increase premiums for payments under underinsured coverage.

For underinsured coverage to apply the at fault has to offer or pay their liability limits. So if there is another party at fault that needs to happen first for underinsured coverage to apply.

It sounds like you rear ended a trailer or vehicle so accordingly you may be at fault and not be eligible for underinsured coverage although your passenger might be.

Your post is old, so you might have already gotten this answer, but your medical insurance will not pay if you were injured in an auto accident. If they do pay, the payment is in error, and when they find out, they WILL request the money back from you, so it is not advisable to try to have your medical policy pay. What I recommend is sitting down with the hospital billing department and applying for hospital charity- there are several programs available for uninsured/underinsured patients that you may qualify for.
