Confused auto accident

I was rear ended and the person that hit my car does not want to involve his insurance company. He has agreed to pay for the damages to my car, rental car costs etc. My question is who should he write the check out too me or the auto body shop and car rental place. I want him to write the check directly to me. Is there a law reference to address this situation. Please advise.

If he wants to avoid insurers etc. he has to do as you direct.

...he would normally want a receipt and a release from you to ensure that you both agree for what he is paying.
