I moved into a new flat 3 weeks ago. I had no cutlery, plates or any kitchen equipment. I went to the local Asda supermarket and bought the said items.
Back at the flat I unpacked everything, the last item being a carving knife. Item was packaged very securely, in fact there was a nylon cable tie like fastening holding the knife to the packaging. I could not get it off so I used one of the table knives I bought to try and split the tie. You guessed it, it gave way with a snap and my hand shot down the blade. I went to the local emergency at hospital who refered me to the plastic surgery unit at another hospital. I had taken a chunk from my index finger and cut through the tendons. I had sugery and stayed overnight in hospital. I am not allowed to use the finger for 6 weeks then I need a further 6 weeks physio. Is there a case for negligence anywhere in this? Sorry, I'm confused are you wanting to sue your self for your own negligence in cutting your finger?

Perhaps you mean product liability?
...i.e. did the packaging cause you to have the accident?? Is that what you mean? It is possible but you will need to show it really is a dangerous defect, and perhaps you could show that it has happened to others as well |
