I was General Manager of a factory.My immediate boss,the then Director was not cooperative,& on 15 march i submitted resignation letter to be effective from 16 march 1998.The then Managing Director asked me to meet him in the office on the next day & after the meeting he asked me to continue with my job with assurance of full cooperation from his side.Accordingly,i continue for more than 1 year.In the mean time my service was regularised.Then suddenly,secretary informed me about acceptance of my resignation letter which i considered dead for their conduct.I submitted " redress of greivances" but then i was issued with "stand release order" on the next day. I filed writ petition,the High Court " estopped the authority from accepting my resignation letter after 1 year" & " the order( release order) is declared to have been passed without any lawful authority & is of no legal effect".I submitted joining report but they submitted " Civil Petition for Leave to Appeal" on the ground of 1).Administrative problems 2)Huge financial drainage etc,& the same was dismissed for lack of merit.I submitted joining report again with the judgment of Supreme Court but now,they are delaying on various grounds namely 1)Having openion of their lawyer 2)Order of the High Court is not clear on my reinstatement 3)How my past services will be counted 4)Whether i am to be paid for my period without work.5)How my retirement benifit will be fixed etc.To all these points i said" if there was nothing in High Court's order or if that was vauge,why did you submitted leave to appeal.In that petition you have admitted the fact of continuation of my service & payment therefrom.Now,you cannot deny the fact you have admitted before highest legal forum & consequently,cannot take the same plea afresh." After that,the authority has informed me about taking approval from the Government which i feel a new ground for delaying my case so that i cross retirement age without joining.My jobless period caused me immense sufferings financially,psychologically at home & outside round the clock.All my friends were gone & i was ousted from elit society i belonged to.Study of my children suffered.Treatment of my autistic baby suffered heavily.List of agonies are long.Humiliations were tremendous.Present attitude of some people are little short of cruelty.

This is occuring in Pakistan.My questions are as follows:-
1)How can i resume work? The authority is killing time to cross my age limit for retirement. 2)If i am allowed to join,how can i get my arrear pay? 3)Can i file a suit for compensation against wrongful termination from service & when? |

If you still prevail on appeal you would be eligible for the back wages normally.
You should get counsel involved now if you have not already. The next level is too technical to handle well alone... |
