widow needs help with pay-out price
I have been a widow for a little over 3 years now, My husbands workmans comp co. is asking me to give the a price for a pay out / pay off. I am 38 years old our 3 children are all of age now. How do I base the price? They did give me an offer that would be about 8.5 years of payments. I told them no. & give them a price for about 24 years of payments and they said no. I am living day to day try to keep my house & help my kids become adults on there own and I am now a mommom, so a pay out sounds good but I have to think about down the road to. The workmans comp co told me to go to a workmans comp lawyer. I am not paying lawyers to do no more for me, I had to get a lawyer for his life insurance and in the end I got 1/3 of the policy that we paid for years the lawyers got more then I did. I just need to know the steps and amounts on how to base a fair price to the workmans comp co. What all to consider before I give a price to them. They tell me we can come to an agreement with out lawyers. I am tired of trying to keep things afloat it seems everything has been a fight since he has been gone. I could go on and on, Thank you for any input you may have to help.

A workmans comp lawyer will often only charge 10% of what you collect and that is well worth the price

Re: widow needs help with pay-out price
10% is well worth it, But in my area the fees i have found are 20% of the pay off. Right now it can just be an agreement no court no work needed. I just need some info on how to come up with a fair price. What is the pay-off amounted based on.
Thanks for any input. Last edited by info.needed : Dec 13th, 2007 at 08:41 AM. |

Not sure in your situation but often the lawyers will take only the percent of the amount over the offer you have already.

Take what they offer, Because if you get a lawyer and they'll get you more then there offer. BUT after a lawyer gets there fees you may end up with less then what they offered.
