So, a month and a half ago I was lifting a 300lb steel slab with my manager and he let go/dropped it and I didnt have enough time to move my foot, subsequently my toe was crushed and was fractured. I went to immidiate care and after the two different casts/boots the bone didnt heal correctly so I now have to have surgery to have a pin inserted. I have been collecting workman's comp checks and they are paying all of the bills of the doctors, but my question is... Do I have a case perhaps? If so, would the settlement be worth the hassle?

I wish to inform you that as you have suffered injury while performing work at the premises of your employer thus you may claim compensation. If your employer refuses to provide you compensation then you may make a complaint to Department of Labor. Work related injuries are also covered under Occupational safety and Health Administration.

Sorry for your difficulties. I would just add that generally workers' compensation is an exclusive remedy, meaning one cannot use that system as well as the traditional tort law litigation approach simultaneously. So, I would just encourage you to confer with legal counsel if you have not already done so. Hope all works out.

Some broken toes need operations to give them the best chance of healing. This can be due to the break being unstable (after manipulation, the bone ends are being pulled out of place by adjacent muscles).

I would think you may have a case. I think the best person to ask would be a personal injury lawyer. They should be able to help you in regards to your claim. It sounds like a bad injury.
