Default getting hurt at home

my son got hurt at home and was off for 3 weeks twisted he ankle when the doctor released him we were on strike but my son was not a union member he worked in the office there non union tey told him to call back after strike so he wated its three weeks now and th keep telling him next week I thought that if you come back from an injurythey are suppose to work you. they tell him to call and he dose playing games with is there anything we can do?
