Default Medical negligence claim -- Steps for making a claim

I had started this thread for those who are facing problem in claiming for medical negligence.

When health professional does not provide the services at the standard level, and through this lack of care causes injury or death, it considered negligence from medical industry. In this case patient can go for medical negligence claims, health care professional providers may also include dentist, physiotherapist this is endless list. That claim should be proved in the court. There are four things need to be proved in the case:
  • The medical bill was paid, if a person is admitted to a hospital or clinic for treatment, there is a legal duty for the health care providers of the institutions to care for the person to the required medical standards.
  • When the duty is assigned to the health professional, it has to be proved that the duty was not done at standard level. The health care provider did not give the required standard of care.
  • It must be proved that contravene of duty caused an injury or death.
  • There must be damages or losses caused by the treatment. They can be pecuniary or emotional, but the basis for medical negligence claims is damages.

There are several steps for making claim and one step to be met correctly before next step can be taken. Firstly medical report needs to be checked by specialist medical expert who will determine if the treatment was negligent and it had done the damage to the patient.

What do you have to establish to make a claim?

- That the care received was not of a standard which would be provided by a rationally capable doctor of the area treating the patient

- That this lack of care has caused an injury or death.

Medical negligence compensation claims are assessed in court on the 'balance of probabilities' this means that you have to dispute that there was more than a 51% chance that the substandard treatment caused your injury.
