I had started this thread for those who are facing problem in claiming for medical negligence.
When health professional does not provide the services at the standard level, and through this lack of care causes injury or death, it considered negligence from medical industry. In this case patient can go for medical negligence claims, health care professional providers may also include dentist, physiotherapist this is endless list. That claim should be proved in the court. There are four things need to be proved in the case:
There are several steps for making claim and one step to be met correctly before next step can be taken. Firstly medical report needs to be checked by specialist medical expert who will determine if the treatment was negligent and it had done the damage to the patient. Proponents of medical marijuana argue that it can be a safe and effective treatment for the symptoms of cancer, AIDS, multiple sclerosis, pain, glaucoma, epilepsy, and other conditions. They cite dozens of peer-reviewed studies, prominent medical organizations, major government reports, and the use of marijuana as medicine throughout world history. Medical negligence cases can be complex affairs so your solicitor will need to collate as much information to support your case as they can.If so, they will likely ask for the following information to begin the process.
What are the contact details of the person potentially bring the claim for medical negligence? Provide a summary of all of the events that have led you towards enquiring about starting a case for clinical negligence. This should also include relevant dates. Provide an account of the actual treatment given and any ill effects as a result. Documentation of any complaint you may have raised with the medical institution or practitioner. Any other supporting documentation or details. |

Quote:
- That the care received was not of a standard which would be provided by a rationally capable doctor of the area treating the patient - That this lack of care has caused an injury or death. Medical negligence compensation claims are assessed in court on the 'balance of probabilities' this means that you have to dispute that there was more than a 51% chance that the substandard treatment caused your injury. |
