Confused Protesting Advocate Fee's ie; Binder & Binder

PLEASE HELP...If I protest Binder & Binder's fee, WILL I HAVE TO WAIT LONGER THAN THE 15 DAY WITH HOLDING PERIOD TO RECIEVE MY BACK DUE BENEFITS PAYMENTS??? I've had a hearing with ODAR and a great Judge who granted my SSD, but due to numerous reasons, many of which have been posted here, I am protesting the fee of $6000 dollars. I chased down and paid for ALL medical records, multiple impairment questionnaire, paid fees left and right for records, (even duplicates because Binder & Binder did NOT bother to find out weather the records they were requesting had been updated in the 1 month interval between the last time Binder & Binder had me request and pay for them, again.) To top it off my rep requested I be 1/2 hour early for my hearing so we could go over our strategy, but he was LATE, of course. We spoke for less than 5 minutes before we were called into see the Admin Law Judge. I felt so unprepared and overwhelmed because I did NOT know what to expect I asked for a copy of all or part of my file, before they send it to be destroyed, and yep you guessed it, Binder & Binder wants me to pay another fee to give me medical records I PAID FOR IN THE 1ST PLACE!!! I am protesting the fee of $6000 dollars. I did 2/3 of the work, Binder & Binder did 1/3 so I sent a letter to the judge offering them $2000 from my back benefits. It's only fair, Binder & Binder only did 1/3 of the work they should only get 1/3 of the fee.

I wish to inform you that your contract regarding hiring of Binder & Binder will govern your rights. Generally, as other party has not competed its work and had shown negligence in complying with its duties therefore you can only be made liable to pay for the work performed under principle of restitution. In this regard as the contract regarding performance of duties was breached by other party therefore you may seek damages if any suffered by you by non performance of duties.

I spoke with Social Security today and found out, in regards to back payments, that ONLY the fee for Attorney/Representative is withheld for 15 days. Hope this helps others out there with this issue

hello i am going through the same thing u r i did most of the work basically everything you said you did.....I DID!!! i have not recieved my benefits at this moment because i was just approved for ssi but now you have me wondering if they would charge me $6000 for somthings they did not do. i paid for all my records which everytime i went to go get those records i had to pay someone gas money....alll they did was call or sent paper work stating i have to pay this i have to pay that. so my question to you is did the judge agree with you? if so will you please let me know so i can start writing my letter to the judge ASAP!!! u was really on point with everything!!! THXS!!!

Sorry for anyone in this boat. This can happen with any case and any lawyer, but it is seen more and more often with the big "chain" disability firms applying a uniform (some would argue "cookie cutter") approach to managing huge numbers of files. Yes, federal law spells out the 6K number, but then again legal fees are always subject to judicial review. So, I say go for it and assert your protest...please let us know the outcome. Good luck!

I just saw that the Senate is wanting Social Security to look at all of the cases that have been represented by Binder and Binder. Some people may even have to pay their won benefits back. If I were you, I would NOT trust these guys. Just look what they did to the guy on the website linked above.
