Unhappy man hole

Fell in 1 of three uncovered unmarked man holes being pumped by paid third party while on duty at work. injured side possible fracture ribs and injuries still being investigated. Have had pain since injury. Any time restriction on filing negligence, also would this be good candidate for pain and suffering as medical as far as I know so far is being covered by work comp. if so how can P&S be figured?
