Confused Speed Bump Killed Cyclist

Hello,

My boyfriend's father, Stan, was recently killed in a bicycling accident while he was riding his bike through a residential neighborhood. He was an avid, cautious, careful cyclist. When we went to the scene in question, we noticed that Stan had been going down a graded part of the road...nothing too steep, but enough that he probably was at 15-20 mph (he had a 21 speed racing bicycle - very light/fast). At the top of the grade, the road was normal (the normal "grey" color the road always appears to be), however, in the middle of the grade, there was a strip of blacktop about 20' long that patched over the entire road in a section, including over a speed bump. The speed bump was a BUMP, not a hump. It was pretty rigid in contour, not very seamless...but camouflaged to a cyclist for certain. It was unmarked, not painted, and there were no signs posted that it was approaching. Would it be feasible to pursue civil action on the property owner/developer? We live in PA, Cranberry Township...a north suburb of Pittsburgh. Any info would be greatly appreciated....

If there was no warning then yes it is possible you could sue. Of course it depends on a number of other factors as well. But it is possible.

That would not be expected by a cyclist and certainly was a danger.
