Speed Bump Killed Cyclist
Hello,
My boyfriend's father, Stan, was recently killed in a bicycling accident while he was riding his bike through a residential neighborhood. He was an avid, cautious, careful cyclist. When we went to the scene in question, we noticed that Stan had been going down a graded part of the road...nothing too steep, but enough that he probably was at 15-20 mph (he had a 21 speed racing bicycle - very light/fast). At the top of the grade, the road was normal (the normal "grey" color the road always appears to be), however, in the middle of the grade, there was a strip of blacktop about 20' long that patched over the entire road in a section, including over a speed bump. The speed bump was a BUMP, not a hump. It was pretty rigid in contour, not very seamless...but camouflaged to a cyclist for certain. It was unmarked, not painted, and there were no signs posted that it was approaching. Would it be feasible to pursue civil action on the property owner/developer? We live in PA, Cranberry Township...a north suburb of Pittsburgh. Any info would be greatly appreciated.... -Nico |

If there was no warning then yes it is possible you could sue. Of course it depends on a number of other factors as well. But it is possible.
That would not be expected by a cyclist and certainly was a danger. |
