PLEASE READ!!! ((Grandfather's Injury))
My grandfather was injured last week while working for a trucking company. He was stepping out of his truck onto the weigh scales,which were covered in ice, and he slipped and fell into a hole after hitting the frozen steel and ice. He broke his T9 vertebret and injured his ribs and chipped a tooth, he was unconcious for at least five minutes. The ambulance was called and the guard at the scales refused to let them in until he was threatened by the driver. They took him to the nearest hospital and he was admitted to the ICU step-down unit. He is 62 years old and has worked as a truck driver his entire life. This accident was caused by negligence from the scale owner (who by the way, had the scales completely cleared off before the state could sent anyone over to investigate, but the EMT's and my 17 year old brother saw the ice as well as my grandfather). How can we make them pay? He and my grandmother have no way to pay their bills and are on the verge of losing their home if something is not done soon. We spoke to my grandfather's boss who informed us, while he was in the ICU, that they do not have Workman's Compensation to cover him, therefore he is, for lack of a more appropriate word, Screwed. From what I understand, when he was hired three years ago his boss had him sign a paper to work as a contract help, which would be perfectly legal had he actually been working as contract labor. As it was his boss had him driving a company truck and was only paying him 30%. A contract labor driver would have to be driving his own truck, either that he owned or leased, and would be payed all of the funds that the truck makes not a mere 30%. So the way it was, he is an employee. So, shouldn't the boss be required to provide worker's comp? and since he didn't, can't he be held responsible too? It just really bothers me that someone like my grandfather, who is the sweetest man I have ever met and would do anything for anyone is being screwed over so royally by negligence. He has worked since he was 15 years old and has never complained, and yet, now he is running the risk of losing his home and the ability to put food on the table all because someone didn't feel the need to make the scales that the drivers have no choice but to use safe for them. Right now my grandfather is laying in a brace in a long term acute care hospital for a minimum of 25 days, after the accident his kidneys started to fail again, his diabetes went haywire and his breathing has become increasingly difficult, he cannot have surgery because the doctor says it could kill him. So he gets to lay in a hospital bed worrying about his bills while his boss and this scale owner have no worries when all he was doing was trying to provide for himself and his wife. Where is the justice in that? Please help me if you can. I don't know what to do and my grandma is beside herself with worry so I need to do all that I can to ease their burden. PLEASE PLEASE PLEASE if you can...Help Us!

It is sometimes hard to sue or collect if ice is the cause but it is certainly possible you have a case based on what you say here; you could take a brief description of these events as well as your medical records to an injury attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you...
You could also email the world law lawyers to discuss your details further if need be. |
