Default injured at work

My hand went through a chain drive at work crushing my first two fingers on my left hand. My employer took me to the hospital where the pa that saw me informed me that my bones were broken but there was nothing they could do as it was the end of my fingers. The skin on the bottom was torn off and one fingernail was torn off as well. They bandaged it and sent me home with an appointment with a clinic that handles workers comp cases the next afternoon. I went into work the next morning with my hand bandaged and wrapped in a piece of plastic as I work in a filthy environment at a coal processing plant. My hand started bleeding so much it was pooling in the plastic so I left after 5 hours or so. I saw the doctor that afternoon and was told that the bones were ok even though they said they had not seen the xrays that the hospital took nor taken any themselves. They bandaged them gave me pain pills (ultram) and said I could work but not to use my left hand. I returned top work and except for a couple of occasions have worked my shifts for the last two weeks after the accident. On Thursday I went to the doctor and he said I could use the hand with limitations like not using those fingers as they will not bend at all anyways abd just to pinch something that type of thing. Now during this time I have been running equiptment that only requires me to push buttons to start and stop belts or elevators so no problems with my hand and as I am one of two people on the shift that could run the equiptment correctly was in fact doing what I would have been doing if not injured with the exception of not repairing the equiptment as well if it broke down. Friday after work my supervisor called me aside and informed me that I am laid off due to restructering. The problem is I do not qualify for unemployment from what I understand as I have been emloyed for less than 3 months by them although worked at the plant for several months. My first five months or so were through a temp agency as that is how they hire new employees. I cannot see potential employers saying " sure ill hire you even though you cannot use your left hand for the most part " So I called and found out that my employer has not filed workers comp and has just been paying the medical bills out of pocket in fact the state said they showed workers comp insurance up untill 1/1/09 not after so I have to call the insurance carrier monday to find out if they even have insurance. I am certain they do or at least I guess I hope they do I am just not sure where to go at this point. The state is sending me forms to fill out so they can pursue workers comp if need be. My question is do I consult an attorney does the state just handle it? I am not sure at this point what to do.

There is something else I bet didnt happen...

an OSHA incident/injury report.

Go file for workmans comp AND UE! Call OSHA and report your injury.

Why? they didnt give you a drug test, or they did'nt tell you (blood sample).
