What state are you from?

In California, the statute of limitations depends on the whether the injured person is a minor or not or whether the defendant is the government or not.
If the claim is made against a governmental agency, the claim must be made within 180 days before you can file a lawsuit.

In case of negligence, you must file a case two years from the occurrence of the accident. The period begins to run upon the date of the injury or discovery thereof.
