6 year old broken her arm in 4 places at school
Hi,I'm wondering if anyone can help me.
2 weeks ago, my 6 year old daughter was pushed off a 1.5m slippery slide at school by another student at lunch break. My daughter's friend (also 6 years old) had to take her to the school's office. At the office an administration assistant applied ice and a band-aid to her arm and had her lie down on a bed. Approximately 20mins later, my husband and I were called to come and pick her up as she 'has a sore arm'. My problems are that: 1. No teacher was on playground duty at the time of the incident; 2. No teacher was seen on the way to the office; 3. The playground has children ranging from ages 5 to 13 years; 4. My daughter was pushed off (not down) a high slide; 5. No ambulance was called;therefore no immediate treatment was had. We were back and forth from doctors to x-ray departments and then the hospital. 5 hours passed until a cast was put on. 6. My daughter had to share a bed with another young girl who was sick; 7. Not all staff at the school are first aid trained; 8. My daughter was in excruitiating pain; 9. The school has never called to interview my daughter as to what happened, and has never called me at home to check on her progress; 9. My daughter cannot participate in any sport/physical activity for at least 3 months; 10. She has been recommended to not continue her gymnastics for about 6 months; When my husband went to pick her up from the school, she had started going into shock. He immediately took her to our local doctor nearby, who agreed she was in shock (hot and cold sweats, nausea, delerious). We were sent for x-rays, which discovered a transverse supracondylar fracture above the elbow (4 breaks in total). Pediatric orthopedic surgery has not yet been ruled out as one of the fragments of bone is out of alignment. Follow-up x-rays are beind conducted in another week. She will have a fibreglass cast on for 8 weeks. We have only been at this school since the beginning of Term 3, about 6 weeks ago. It is a private school. The school has not contacted us about the incident, so we organised an interview with the principal, who totally agreed that all of our concerns are warranted and all that had happened was inexcusible. The school has no insurance for accident and injury, and we are so far 'out of pocket' $350. All we are wanting is to cover our expenses, but the school does not seem to want to continue with any of it anymore. What can we do and what are our options? I feel your pain as a mother. My son at 9 yrs old jumped out of a swing at school and broke three bones in both arms. he laid in the dirty screaming and crying while the teachers slowly walked over to him and for at least 15 min where trying to get him to stand up and walk to the office. when they called me and i rushed to the school my little boy laided in the dirty screaming for me when i got to him the teachers keep saying you need help to get him to the car. i was stund you could see plain as day that my son had three bones out of place and they wanted me to move him. i yelled at them to call an ambulance. when they got there my son had been laying in the dirty for over 30 mins screaming out for help. he had to have surgery when they got him to the hospital and spent 7 weeks with cast up to his armpits. he ( who has always been a happy child) would not talk to anyone or smile for weeks. two days later the school put out all new mulch which led me to believe that the old mulch was past its time so it felt like hitting concert to my son. his elbow bone will never be the same unless we rebreak it and hope it stays in place with out putting a metal pcs. in to keep it in place. he can move it but it bows out now more curve than straight. so i do feel your pain its been two years and really didnt know if i could do anything about it and to be honest i didnt think about it till now all i wanted to do then was see my son get better. I wish i would have and now i dont know if to much time has gone by.

I would check in with a few injury attorneys and see what they think about the details of your situation.
That does seem horrible and maybe the school indeed was negligent? |
