My son was injured by hedge trimmers 3 years ago resulting in a 2-3 inch hypertrophic facial scar. He has had surgery, laser treatment and steroid injections multiple times in these last 3 years. He is 17 now and has just had his last surgery for revision. (I hope). Workers Comp has paid for everything. 1 year after all the revision work is done, we go back to court for the final determination of settlement. What is the normal settlement for a facial scar under workers comp in NYS? It is very noticable ...mostly because he scars badly , but also because of the location. (from the bottom lip down over his chin). Do they take into consideration all the suffering through surgery and treatments? Or his age?? It does not hamper his ability to work now or in the future....it just looks terrible. Thank you.

Yes all of those factors apply as well as any possible future costs to try to further lessen the scar etc. You may want to have a lawyer consult with you about the possible outcomes and reasonable amounts expected given all of the facts etc.--even if you decide to proceed handling it by yourself...
Two or three times total medical costs is sometimes a very rough estimate, depending on who was at fault, how it happened etc. |
