Ask A Lawyer:
From: Valinda Sanders (vs5917@att.com, ) Area of law: (Not sure which area) Country: United States of America State: Georgia My child ( nine year old boy) was at a birthday party next door. Once the party was overall all the children came outside. The kids started playing with some golf clubs which a neighbor returned to the yard which I was not aware of. I had instructed my boys to not have those clubs outside. All the little boys from the party started playing with the clubs because our houses are very close, and all kids play in each others yards unless it is fenced in. The neighbor's party boys asked my son to show them how to play with the clubs because they were swinging them like a bat. He showed them but on demonstrating a second time one of the little boys was running by and was accidentally hit in the eye. It caused a significant gash that required 12 stitches at the emergency, and his mom said he would be scared for life. The mom is not the owner of the house. At the time of the injury all of the parents at the party were in the house or back yard (which is fenced in). I was in my house. 15 minutes earlier my sons had reported in as they have to report in periodically. When the injury happened the boy's parents took him to the hospital. Am I liable for all costs due for his medical bills? I told the parents I am willing to split the bill in half as there should have been a responsible adult watching the kids. I was at least responsibility for some portion because my son caused the injury, and I was not watching mine because he was next door at the party. |

Your insurers should sort that out. Do you have homeowners? You may not actually be liable there. Or liability may be spread across all that were involved in this event.
