Unhappy my boxer bit the neighbor boy

help, i live in oregon. we have a boxer since he was a puppy. he is 5 years old. i have son that is 10 and a 2.5 year old. the neighbor has terrorized our dog over the years. we have spoke with his grandma, spoke with the boy. when i see him i bring the dog in. my son had friends over and they were running in and out and the dog got out and went over to my husband and sat next to him on our property while he spoke with his grandma, the boy went to pet rudie and rudie bit him on the mouth and he got 18 stitches. rudie didn't run after the boy. the boy fell down and the grandmother and my husband watched as he ran inside his house and then his grandma went after him to find him bleeding. we have the one bite rule here in oregon. we had no idea that rudie would do this. this boy has been around rudie in the past with us around and has pet him before. rudie has not shown any aggressive or mean behavior towards other animals or people, kids. i do have lots of kids at my house at different times. i'm sick to my stomach that my dog has done this. we have apologized to the boy and his grandma. we have always been cordial and neighborly.

my question in the state of oregon is it still the one bite law? is it up to the judge to determine if we will be liable. the boy has had some part in hurting our dog. they have also had a dog taken away b/c they have not taken care of it properly. it was always on the loose and in everyone's yard. also, how should i prepare my defense? i have put up beware of dog signs on the fences and in my window. i have gotten letters from neighbors about rudies disposition and the boy's disposition. we are getting a muzzle and we will not allow our dog in the back from now one. i don't trust the neighbors nor my dog around the neighbors
