Is my case strong??
Hi
I am student in the United States. I am Palestinian from East Jerusalem. I went in the winter vacation to my home country. When I went to check my luggage in with Delta airline, their system did not accept me because I had a travel document, not a passport. The clerk phoned Delta global office and the officer there told her that there is a new American law called Western Hemisphere Travel Intitiative that prevents the holders of travel documents from entering or leaving the United States unless they have an emergency travel document issued from their embassy. This law became valid on the first of Octeber 2007 while I was in the United States. I told the officer that my DS form was signed by my sponsor and that there was no problem (my sponsor is supposed to know all the emigration procedures). The officer made it clear that there was no possibility for me to leave the United States which meant that I would lose the price of the ticket and I would have to travel to my embassy in New York to issue an emergency travel document. I phoned my sponsor and he told me that my documents are legal and perfect and that this new law is not applicable on me. Delta refused this and insisted on its stand. I had to change to another airline which allowed me to leave the United States without any problem, and I returned after the end of the vacation without any problem as well. My question is that I want to sue Delta for causing me emotional distress and for hindering my freedom of movement ( a basic constitutional right in USA) without any legal warrant, what are my chances in this case if I ask for monetary compensation for the damages inflicted on me??
Thanks
