Does wife with K-3 need to travel for AOS?
I married my wife at Guangzhou, China. We applied for a K-3 visa and was approved, and she is now in USA with me. For the residence visa, does she has to travel back to China for her interview and receiving resident visa approval, or can it be done at the local HSCIS office here in USA. I was told when we filled the K-3 that she will be applying for both, the K-3 and the resident visa at the time by the US Consulate at Guangzhou.
She claims she was told when the K-3 visa was granted, that she could come to USA and live with me until the resident visa process was completed, then she will be contacted to return to Guangzhou for her final interview and getting the Green Card. They claimed this can't be done inside USA, that she must re-enter USA with the Green card. Is this true? Very expensive proposition, for her and me to go there will cost $ 5,000 USD minimum, between airfare, hotel, taxis and food. Many thanks for your attention and reply. |

neither of the two articles will state if a K-3 Visa holder while requesting a resident visa must go for final interview with husband to the local office within the USA, or as my wife was told, must return to Guangzhou, China with me for that.
I do know trhat the K-1 final interview is done here locally, why not the K-3? many thanks |
