I am lost

I just got married here in my country with an american citizen and just sent all documentations of us to The USCIS (I-130). The problem is he must send the AOS form,might be in the next 3 or 4 months) which he needs to file the latest 3 years of his taxes which one of those years he put his friend's name as his spouse..just to get more money back and now we just found out that in Alabama use the common law marriage.we are not sure if this makes her and him become husband and wife automatically, but they never live or use my husband last name or joint bank account together and NEVER consider themselves as husband and wife..just the thing that he cheats on his tax return form. What should we do? He proved himself and always knows that he is a single and married me by having a divorce paper(he got divorced for more than 5 years) and have done right every step. Am I his legal wife? What about my visa that running in the process now?We want to solve this problem while the process is riding on.Please give me some of your advices.We are worried and don't want our marriage to be fraud.

That is tax fraud but it does not make him married.
