K1 with criminal conviction

Confused K1 with criminal conviction

Hello, I am currently in love with a lady I met and have been corresponding with for about a year now. I have visited her in Ukraine and we are both ready to have a life together. The problem is that she is facing up to some unfortunate choices she has made in the past. She was involved in a situation where she worked as an online stripper. Now, as a result, she has been charged with the production of pornography. I could give a long story to try to make this sound not so bad but will spare anyone reading this the time. Ultimately, I think she is worthy of my love and forgiveness for anything that is not so morally correct. BUT...the Ukrainian court system takes this very seriously. She will almost certainly have a conviction of some sort. Her case is in the courts now and will not resume until late Sept. She has a lawyer/advocate...but I am not sure how good this person is with Ukrainian law. It's hard to know how to find a good lawyer there. She is looking for a second lawyer just to make sure she has good representation.

So...my questions...

Can we get a waiver for her to come here on K1 Visa....so we can have a life together? Will we have a chance for success? I am very scared from this! I truly believe she wants a normal life, loves me and wants to have a family. I love her so much that it is so hard to accept her situation. Her choices were bad...but much a part of circumstance, ignorance and timing.

I cannot leave US yet....but I would so if my retirement was closer. We want to meet again and I will take my second trip to be with her very soon. I would like to think we can have our dreams...even against all of the odds. So...
Should we marry in Ukraine and try for K3 Visa or go with the K1? Are we doomed because of her situation? Can we do this successfully? Will the USA let her in...because from what I have read...they say no to convictions? I am sick with worry and want someone to give me good news....to give me hope. Any help would be much appreciated.

If she is convicted it will not be easy to get her here. But you can hire competent US counsel to make the case that the conviction was not in accordance with US standards.
