Default Timing and J1 visa - I'm subject to the two year rule

Hello,

I will travel to the US with J1 visa and I am subject to the two year rule. I will leave the us in August 2010.

I will stay in my come country for 1 year and then I will go back to the US with F1 Visa in September 2011.

I know that I have to go back to my home country after F1 Visa ends and have to stay there. But my question is, for how long do I have to stay in my home country? Is it still 2 year? Or since I stayed in my home country for 1 year and went back to the US, is my requirement 1 year?

Generally speaking, you are required to spend the full two years in your home country unless you have obtained a waiver. That said, there are certain options that can delay the home year requirement. For example, if you are physician on a J1 you can still apply for an O-1 under the guise that once the term of the O-1 is complete, you will fulfill the requirement at that time.
