To Whom ,,, Im not sure where to begin here , My name is Jimi and my partner is a Canadian citizen that came over to the USA back in 1998.He had a 7 month visa and is still here in the USA . We have been lifepartners now for over three years. He has been a mainstay of our family which includes my two youing sons who I have sole legal andphysical custody of . We a re basicaly a same sex parenting family. Mypartner has proven to be an excellent parent I couldnt hae asked for abetter person to raise my children with , he is indeed a fantastic and loving poarent . So heres the deal , his visa is way way expired , he did take atrip back to canada approx, two years ago for a period of 4 weeks andwas able to somehow come back thru with out detainment fromimmagration services on either side of the border . How and whgat dowe need to do in order to obtain a permanent visa for him ?? We areplanning to obtain a civil union here in Cal. and are wondering whatif any difference that would make ??? Iether way ? Where do we start this process and how would it work ?? Our biggestconcern is that coming forward my partner will be forced to leave the USa fopr an extended period of time causing severe finacialcircumstances within our family stucture . All though he does maintain a current Cal. licsense as well as a Social security card, which isimprinted with the words "Not For EmploymentPurposes" , My partener has worked consistently under the table or independently and we wishto bring all thios about to where everything is on the up and up . What do we do , We are a low income family of four we are not on anytype of social assistance and barely, barely make ends meet on apaycheck to paycheck basis . Please can ypou give me some kind ofadvice on where and how we might be able to keep my partner in the USAand at the same time bring his legal and employment status into legal bounds ? Very respectfully,,,,,,,,,,

If he overstayed the visa then he can stay if he has a traditional marriage but currently not with your marriage. The new administration could change that.
I would suggest you meet with immigration counsel to review your details or email world law directly to discuss. but it does not look great at this point... immigration reform legislation may help you, and it is likely. |
