Confused vwp change of circumstance

I have been travelling to the US from UK for 5 years with the vwp. I tend to stay for the whole 90/7 and go home for about a month. I have a boyfriend and his family in the US where I stay. He has recently finalised his divorce.The last entry to the US I was stopped at immigration and questioned and have been told that I may not get access to the US next time I come through as it appears that I am living here, which tecnically I am, although I always leave within the specified period.
They advised me to apply for a 6 month visa which I know I will not get as my ties to the UK are not strong enough. I am retired, no home, no job and little family. I am 57 years old, female.
If we get married here within this 90 day period, can I apply for a change of circumstance or will I have to leave and come back in as a fiance?
Any advice would be helpful

You often can stay and adjust status here as long as you did not come with the intent to marry.

Can I change status while within my 90 days if I marry in the USA??

If you marry you will get the change without having to leave.

How close to the end of the 90 days can you send in an I-130??
