Confused What is the human rights of a special child?

A special /developmentaly delayed child,who was getting special education in USA(Her own country).She was left by her father in other country without any support and escaped somewhere.The father is not taking care for her special education and medical treatment. Is the father violating the human rights of his special/developmentally delayed child? The child is entitled to get her treatment in USA but can not get it as she is mentaly retarded.
