Default Some questions relating to application procedure to the ECHR

Dear colleagues,

We are considering having and application to the European Court of Human Rights. We have Turkish nationality.

We have some information on how to do it. However, we need further information on the issues written below:

1- We will collect all the documents that may be needed by the Court and will translate it into english. We also will make application online making use of the website of the Court. Then, we will post the copies of these documents. Should we attach the original (Turkish written ) documents? Should we also attach the Turkish version of our statements made in our online application?

2- Our application will be relating to the Court decision. The decision was approved by the Supreme Court. There is no ordinary remedy. Howewer we have an extraordinary application opportunity which does not prevent the Court decision to be executed. Do we have to consume this extraordinary way as well?

3- Should we have stated the provisions of the European Convention of Human Rights during any stage of trial? Is it a condition for us to apply to ECHR?

Thank you very much in advance.

You should attach the Turkish originals as well.

You have to exhaust all normal court proceedings before applying but you normally need not also have finished extraordinary remedies.

World Law's lawyers could also probably help if need be. You may email them on the home page.
