I have had the missfortune of needing a surgery for a third time on the same thing because of a reoccurring cyst. This has been the third surgery in appx. 8 months. My employer says that I am running out of FMLA leave and if I don't return to full duty work by Feb. 29 that my job will be terminated. My doctor said that I could go back on light duty but my employer said that it wasn't allowed because light duty was only given to those who were injured on the job. I have been working there for almost 3 yrs. and have never been in any kind of repremandation, never written up or had my ethics or abilities questioned or challenged. In short this is the only thing that has ever been on my employment record that could be even considered bad. Can they really fire me?

They cannot fire you solely for a real and serious illness.
You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...try speaking to a higher level of management about the issue; |
