I will just get straight to the point. 3 months ago, there was a restructure with the promotion of our contruction manager as the COO of the company. Since then, I was informed that I was unable to discipline my employee and that they do not follow the system and some were coming to work late; hence he made the decision of having our vp of sales do the training for my marketing department. Since then, I received many critism from my COO, specifically that I do not possess the "pizaz" to lead the marketing department and that I was always late to work. Now I have been late before but I have always committed more than 50 hours a week to work and complete my task. I had a meeting with my COO before and he stated that my current immediate supervisor and my previous, which was the GM of the company, felt that I am a great and a hard worker; but he doesn't see that with the little encounters that he had. Prior to the COO's promotion, I was offered a bigger and better job somewhere else; my GM persuaded me to stay and matched my salary with the verbal promise to greater opportunity; hence, I declined the offer and eliminated the opportunity I had with the other company. My immediate supervisor was very close to me and since the start of the criticism, he has been informing me about their intentions of replacing me with another person.
Now back to the vp of sales (lets call him Bob for short) conducting training, my employees became very disgruntled towards Bob's demeaning style of training. Up until this point I had no control over my training anymore. Recently most of my employees (around 5-7) decided to off and leave the company due to the demoralizing way they were treated in the training room. I was called in today and "clarified" by my COO that they heard the rumor that I am under the impression that I am going to be replaced by another person (Joe); and that it wasn't the case because the Joe was only brought in to do business development within my department. And now due to the mass resignation of the department, they felt that I did not have control over my department, even though I was never given the chance to improve on my "mistakes," and with everything the way it is, they are forced to now replace me with Joe and give me the only option to manage the telemarketing department. Eversince the first time I met my COO when he was a contruction manager I could sense that he did not like me. He has made many attempts to defame my character by saying that I do nothing in my position, or at least that's what he saw. I feel that it was a constructive discharge/demotion because he is basing it on a subjective thing as the lack of "pizaz." Even though I had no control over my employee's training, I was told that I was solely accountable for the resignation of all my employees and that I was the manager of the department, I should've taken actions to prevent it. I told him in our meeting that I asked for all my employee's committment to the new change multiple of times but he refused to understand(I have witnesses for those conversations). My immediate manager is very upset due to this fact. He is part of the uppermanagement involved in all these constructive actions and he is willing to testisfy for my justice. Could someone please help me with this? I have refused a great opportunity somewhere else and now they gave me the shaft with unjustified cause of action. I would be very thankful if someone could shed some light on my situation if my COO is right or am I right? Everybody I've talked to within my company felt that it was unfair and the intention was there from the getgo. Thank you for your help in advance. |

You really can take action legally in that situation only if you had a specific agreement and commitment and can prove it. And you would likely have to show that you relied and lost other opportunities.
Have legal counsel review the details if you think you can show some agreement was reached. Vague promises and the like will normally not suffice. |

Thanks for the reply Able1. Alright, I am glad you brought that up and that is my question that I have for you or anybody who could help me out. I do not have a written agreement by my GM that they will provide me with more opportunity with the company but I do have an offering letter still from the other company. You will see that the date on that offering letter is before my current company match the same salary compensation. It has only been 3 months, obviously, for a company to match another company's offering, that only mean one thing, the company wants to retain the employee and show the employee that there is greater benefits in the company, such as opportunities and growth. But instead I am getting a demotion. Do I have enough evidence to build a case here?

You could try it would seem to me. They indeed could compromise with you or seek to resolve it.
