Default Conflict of Interest?

I've been working in the graphics industry for 11 years. I work for a small graphics company in Michigan that provides a wide range of graphics of different types. This company only allows 40 hours to be worked, no overtime. For extra income, I'd like to start a graphics business on the side, out of my home, and continue to work for the company I work for now. I would not conduct business of my own on their time, but only after hours on my own home. I would also not take or use any of their existing customers. Can I do this legally? - and could they legally fire me for doing this? Thank you.

No--you cannot compete with your employer!

I am not an attorney. That said, you should check the employee handbook. In some industries, it is common practice for employers to forbid employees to moonlight (to do their specific kind of work outside of work). In others, it happens all the time and they don't have a problem with it. Each employer determines whether they allow it or not, and it should be in the employee handbook. If it's not, ask your boss.

I would reconsider your actions if they had you sign a "Non-compete" agreement. As long as you do not use any of their templates, designs, equipment or try to seek business from any of their clients or clients of your's that you gain through relatable sources, you should be fine...

With that being said, if they feel you are acting inappropriately, you can be terminated because of the thought you would be taking away potential business from your employer.
