I was fired abruptly without warning. I was shocked.
I was there just under 8 months. I had never gotten any verbal or written warnings. Can I sue and win? |

Unless you have a contract or some employee handbook that governs this etc., they can pretty much fire you as they wish, just as you can quit as you wish without notice.

You need to google "at will" it will explain why you cant sue and how the firing was lawful

The advice given is true. You can quit or be fired without notice.
This is another area where relations are one sided in employer/employee situations. Employees are expected to give at least 2 weeks notice, under the guise of the employer having time and opportunity to replace the employee leaving, and to get the new employee trained. But when a firing takes place, usually the employer is sneaking around behind the employee's back putting ads in the paper, having interviews next door, and the firing is sudden. Employer's don't worry about the 2 week notice (for their own benefit and no one else's) when they're firing you, but if you want to quit and expect a good reference, and to not "burn bridges behind you", you are expected to give a 2 week notice. Either way, both scenarios favor the employer and not the employee. It's just another labor law that needs reform. |

There is no that demand notice by employee. This is just a nice jester to maintain good relations with former employers but is not mandated. An employee may quit without notice as well

There was no mention of a "demand" notice... The post says it is "expected" of the employee.
The trouble is, there is no "nice gesture" on the employer's part when they are firing an employee. It's a strange, small world and maintaining good relations is a two way street. |

Severance pay is a completely separate issue.

Yes and no. Severence is a "nice gesture' as is giving notice. I used to make my point. The employer is not obligated to give serverence anymore than the employee is obligated to give notice
