Default Employee Records

June 30th a request to provide me with copies of my employee file was sent to employer. As of today they still havent been recieved. Is there a time frame of how long they can wait to send them back or can they just do it whenever they feel like it?

Each State differs, I'm sure, but I believe they have 30 days from date of receipt of request letter. Did you send the letter Certified, Return Receipt Requested? Did you keep a copy of your letter?

Check with your State's rules on this. If you don't receive a reply within the 30 day period, send a 2nd request, this time Certified, Return Receipt Requested. This will ensure that you know when they received the request. Then, if you do not hear from them within the allowed time period, they have violated the law.
