Violation of FMLA?
In September of 2005 I was involved in a car accident that left me with some health issues requiring regular visits with my doctors. I qualified for FMLA and was placed on it to cover my appointments and times when I was sick and would need to leave work to get better. Though the appropriate forms were filled out and placed in my employee file, I was terminated due to a company policy that required you to work a certain number of hours during a month based on how many hours you were scheduled during the week. Would this have been a violation of my FMLA leave seeing as all abscenses would fall under that leave? As a note, during the month I was fired for, my schedule would always have time removed out of it and then placed by in after the fact. When I would miss time, HR would simply remove the time from my schedule that I missed with FMLA.

Yes that is a violation of FMLA....Contact an Attorney!
