Default Wrongful termination: I was terminated for being absent.

I was terminated for being absent. Medical conditions here and there for myself or my child. I would ask if I could take fmla, was told no because my time away was not long enough or the conditions were not serious enough but between all of this also being told that I didn't have to worry about it because they understood and that I was a hard worker. Out of the blue.....your terminated...then...protesting the unemployment! I have since found out that my rights have been violated by a small company I (along with all the employer there they gave understanding to) thought they actually did care about what was happening. Everyone was shocked.

Some questions

How many employees within 50 miles?
How much time off were you requesting?
What were the reasons? (list all in detail)
How long have you worked there?

You can be fired for absence and this could effect UI benefits but first answer these questions

The company has enough employee's and grants fmla, I was there over the 12 months and over the 1250 hours. My child has chronic health issues so it would have been for specialist appts or my child actually having an outburst of the condition. So time off I asked for were a week here or there, few days here and there. You don't know when it's gonna happen.

Sorry to say but employers can fire for absenteeism, regardless of the reason. Employers care about only one thing; their own business. It matters not to them what your reasons are. It's simply not their problem. They are looking for bodies to fill time slots and if you're not cutting it, they can and will replace you with someone who will.

This may sound cold, but unfortunately, it's simply cold truth.

Cut your losses and move on.

NO...they can NOT fire for absent regardless of the reason if the reason is medical condition that qualifys for fmla.....,that is against the law!!
