I was recently fired for failing to pass a random drug test. I do not use drugs and I have no idea how they got in my system. This has completly devestated me. I know for a fact that a male coworker of mine failed a drug test and they tested him two additional times of which he passed and he is still employed by this company. They terminated me immediatly and did not give me the option to retest. I feel this is discrimination and am wondering if I should follow up on this with an attourney.

If the test was indeed positive, it would be incredibly difficult to prove any sort of discrimination. Unfortuantely, just because the company let another employee slide does not mean they had to continue your employment despite a failed drug test. If your company has 15 or more employees, your best step would be to contact the U.S. Equal Employment Opportunity Commission (EEOC) and file a claim (no charge). Hope it works out. AJJ
