Hi! i got these questions in HR Class and need some help.
Scenario. Our Client, a female has alleged that she wassubjected to significant sexual harrassment byher male employer, over a considerable period of time. Our client alleged that her boss frequently asked her our for dates, sent her suggestive messages and telephone calls. Lisa consistently turned him down and anything that appeared to encourage the perpetrator. The Harrassment got worse. When she complained about it further, she wa subject to disciplinjary action and demoted. At that point she consulted us, resigned claiming constructive dismissal and sexual harassment. On the morning of the tribunaal the employer capitulated completely and our client received a five figure settlement, without having to go through the ordeal of giving evidence and proving her case. Questions. a) If litigation had actually occurred , outline an argument on Lisa's behalf for presentation in court. b) Discuss the concepts of (1) Constructive dismissal and (2) Sexual Harrassment. c) As a Human Resourec Specialist, suggest a procedure/policy guidline that an employer can use to prevent and or handle sexual harassment issues. |
